Lehrinhalte: Recht der Digitalisierung: Die Digitalisierung der Wirtschaft ist weit vorangeschritten und wird zunehmend durch den europäischen Gesetzgebers gestaltet. Zudem haben Gerichte, insbesondere der Europäische Gerichtshof sowie das Bundesverfassungsgericht, die Maßstäbe zum Umgang mit personenbezogenen Daten entwickelt und verfeinert und somit auch Anforderungen an die gesetzgeberische Ausgestaltung der Digitalisierung formuliert. Die Vorlesung legt den Fokus auf die wesentlichen gesetzgeberischen und judikativen Antworten auf Digitalisierungsprozesse. Das Datenschutzrecht wird genauso behandelt wie das Informationszugangsrecht. Das Hauptaugenmerkt liegt aber auf dem Digital Services Act (DSA), dem Digital Markets Act (DMA), dem Data Act (DA) sowie dem AI Act (AIA), mit denen der europäische Gesetzgeber den einzigartigen Versuch unternimmt, die digitale Transformation aktiv zu gestalten, eine Wettbewerbsordnung der Digitalwirtschaft zu etablieren und möglichen negativen Entwicklungen – bspw. durch den Einsatz von KI-Technologie in sensitiven Bereichen – zu begegnen. Alle drei Kerngebiete der Vorlesung – Datenschutz, Informationszugang und digitale Märkte – werden prägnant, konzise und mit unterschiedlichem Anschauungsmaterial behandelt. Digitalisation and Law: The economy has been mostly digitalised. This process is, however, increasingly being shaped by the European legislator. In addition, courts, in particular the European Court of Justice and the German Federal Constitutional Court, have developed and refined the standards for dealing with personal data and thus also formulated requirements for the legislative design of digitalisation. The lecture focuses on the essential legislative and judicial responses to the digitalissation of the economy. Data protection law will be dealt with as well as information access law. However, the main focus lies on the Digital Services Act (DSA), the Digital Markets Act (DMA), the Data Act (DA) and the AI Act (AIA), with which the European legislator is making a unique attempt to actively shape the digital transformation, to establish a competitive order for the digital economy and to counter possible negative developments - e.g. through the use of AI technology in sensitive areas. All three core areas of the lecture - data protection, access to information and digital markets - will be covered concisely and with different illustrative material.
